General Terms and Conditions

This is a translation for your convenience. The German version is legally binding: Allgemeine Geschäftsbedingungen.

§ 1 Scope and provider

These terms apply to all contracts for the hosting of servers (for example Minecraft servers and bot servers) via hosting.navoryx.site between Jörg Stuff (Navoryx), c/o flexdienst – #22262, Kurt-Schumacher-Straße 74, 67663 Kaiserslautern, Germany (hereinafter “Provider”) and its customers (hereinafter “Customer”). Deviating terms of the Customer do not apply.

§ 2 Services

The Provider makes available to the Customer a virtual server container with the ordered amount of memory (RAM), a proportional share of SSD storage and the features stated on the order page (backups, databases). The server runs on hardware of Hetzner Online GmbH in the Falkenstein data centre (Germany). The Customer manages it via the customer area and the Pterodactyl panel and can transfer files via SFTP.

The Customer shares the physical hardware with other customers. Processor capacity and network bandwidth are shared fairly; the Provider does not guarantee them. The Provider endeavours to achieve an availability of 99 % as a monthly average. This excludes announced maintenance and disruptions for which the Provider is not responsible (for example attacks, outages of the data centre or of upstream networks).

The Customer is solely responsible for the content, software, plugins and settings on the server. The backup feature is an aid. The Customer additionally backs up important data themselves.

For consumers, the statutory rights for defects in digital products apply (§§ 327 et seq. BGB). To the extent required to keep the service in conformity with the contract, the Provider supplies updates, in particular security updates of the server environment and the panel.

§ 3 Account and conclusion of contract

The Provider maintains a customer account for the services. The Customer creates it in advance with a Discord account, an email address or their panel login. If the Customer orders without signing in, the account is created after payment from the email address they provided to the payment service provider; they receive the login details by email. Customers must be at least 18 years old or act with the consent of their parents or legal guardians. The contract is concluded when the Customer selects “Order with obligation to pay” on the order page and completes the payment with the payment service provider Stripe. Right afterwards the Customer receives a contract confirmation by email containing these terms and the cancellation policy.

The contract languages are German and English. The German version is binding. The Provider stores the contract text. The Customer receives it with the contract confirmation and can access the terms on this page at any time. The Customer can recognise and correct input errors until the payment is completed: on the order page by changing the details, and in Stripe's checkout via “Back” or by closing the checkout.

§ 4 Obligations of the Customer

The Customer uses the server only in compliance with the law. In particular, the following are prohibited:

  • unlawful content and the infringement of third-party rights (for example copyright or trademark rights),
  • attacks on other systems, port scans, spam, phishing, botnets and the distribution of malware,
  • crypto mining, proxy or VPN services for third parties and file-sharing services,
  • actions that disrupt operation for other customers, such as sustained full load beyond normal game or bot operation.

If there is a well-founded suspicion of a violation, the Provider may temporarily pause the server to the extent necessary to prevent damage. The Provider informs the Customer of this. In the event of serious violations, the Provider may terminate the contract for good cause. The Customer keeps their login credentials secret.

Anyone can report illegal content on hosted servers under the Digital Services Act (DSA), via the page “Report content” or by email to contact@navoryx.site. That page also names the point of contact under Art. 11 and 12 DSA. The Provider reviews notices manually, without automated decisions. Possible measures are removing or blocking individual content, pausing the server and, for serious or repeated violations, termination. The Provider informs the Customer of any measure by email and states its reasons. The Customer can object by email within 14 days. The Provider then reviews the objection again manually. The notifier is told the decision if they provided an email address.

§ 5 Prices and payment

The prices displayed at the time of ordering apply. All prices include statutory VAT. The Customer pays monthly in advance via Stripe, using the payment methods offered there. If the Customer increases the memory, the Provider charges the difference for the current billing period immediately on a pro rata basis.

Instead of paying monthly, the Customer can choose a term of 3, 6 or 12 months when ordering. For this, the Provider grants a discount of 5 %, 10 % or 20 % on the regular monthly price. The amount for the entire term is due in advance when the contract is concluded. Vouchers and referral discounts do not apply to terms. If the Customer adds memory or backup packs during the term, the Provider charges the additional amount pro rata for the rest of the term with the same discount.

In addition to the included backup slots, the Customer can add add-on packs to their subscription at the displayed monthly price. When the Customer adds a pack, the Provider charges the amount for the current month immediately on a pro rata basis. When the Customer cancels a pack, it ends immediately. The Provider credits the unused part of the current month on the next invoice. Existing backups are kept when a pack is cancelled.

If a payment fails, the Provider informs the Customer by email and the server continues to run for 3 more days. If the payment then remains outstanding, the Provider pauses the server until the amount is settled. The data is retained for as long as the contract exists.

§ 6 Term, cancellation and deletion

The contract has a term of one month and renews for a further month each time unless it is cancelled. The Customer can cancel at any time, effective at the end of the current month: in the customer area (subscription), via the page “Cancel contracts here” or by email to contact@navoryx.site.

If the Customer has chosen a term of 3, 6 or 12 months, the contract initially runs for this term. After that, it continues for an indefinite period, is billed monthly at the regular monthly price without term discount displayed at the time of ordering and can be cancelled at any time, effective at the end of the current month. A cancellation during the term takes effect at the end of the term. There is no pro-rata refund for the remaining term; statutory rights, in particular the right of withdrawal and the right to extraordinary termination, remain unaffected. The Provider notifies the Customer by email no later than 14 days before the end of the term about the change to monthly billing.

After the contract ends, the Provider pauses the server and permanently deletes it with all its data 14 days later. Until deletion, the Customer can download their files and backups free of charge, via the panel or SFTP. To do so, “Download data” in the customer area unlocks the server for downloading for 24 hours each time. The server cannot be started during that time. The right of both parties to extraordinary termination for good cause remains unaffected.

§ 7 Changes to prices and terms

The Provider changes prices of existing contracts and these terms only with the express consent of the Customer. The Provider notifies the Customer in text form at least six weeks in advance. If the Customer does not consent, the previous terms continue to apply until the end of the paid period (month or term), and the contract is not renewed thereafter.

§ 8 Right of withdrawal and money-back guarantee

Consumers have a right of withdrawal. The details are set out in the cancellation policy. If the Customer expressly requests that the server be provided before the withdrawal period expires, they owe compensation for the service provided up to that point in the event of withdrawal (§ 357a(2) BGB, German Civil Code).

In addition, the Provider voluntarily grants a money-back guarantee: a new customer can request a full refund of their first payment within 24 hours after the first start of their server, via the button in the customer area or by email to contact@navoryx.site. The guarantee applies once per customer. With the refund, the contract ends and the Provider deletes the server with all its data. The statutory right of withdrawal remains unaffected.

§ 9 Liability

The Provider is liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act (Produkthaftungsgesetz). In the case of slight negligence, the Provider is liable only for breach of an essential contractual obligation, limited to the foreseeable damage typical for this type of contract. Essential contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the Customer may regularly rely, here in particular the provision of the server. For loss of data, the Provider is liable only to the extent that the damage would also have occurred had the Customer backed up the data properly.

§ 10 Data protection

How we process personal data is described in the privacy policy. If the Customer processes personal data of third parties on the server (for example player data), the Customer is responsible for this. For this case the Provider provides a data processing agreement under Art. 28 GDPR. This agreement applies upon conclusion of the hosting contract insofar as the Customer processes personal data on the server.

§ 11 Dispute resolution

The Provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG, German Consumer Dispute Resolution Act).

§ 12 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, the protection afforded by mandatory provisions of the law of the state of their habitual residence remains unaffected. Should individual provisions be invalid, the remainder of the contract remains valid.
